A man in the country illegally has been convicted of rape.
The Madison and Rankin counties' District Attorney said Jose Mejia-Cubias, 37, pleaded guilty to sexual battery in Madison County Circuit Court. On Monday, a judge sentenced him to 25 years in prison without the possibility of early release or parole.
The Madison Police Department was called to Fernando's Mexican Grill Madison on Colony Crossing Way around 1 a.m. on Jan. 30. A woman who was drinking at the bar said the bartender raped her.
Surveillance video showed Cubias serving the victim drinks until she passed out, almost falling on the floor, according to police. Afterward, police said the video shows Cubias sexually assaulting the victim while she was unconscious on the floor.
Cubias was indicted four days later for sexual battery of a physically helpless person.
Authorities said he is in the country illegally from El Salvador and is still facing pending charges for illegal entry into the United States. Cubias was previously deported in 2010.
